Canon U.S.A., Inc. (“Canon”), provides the CANON iMAGE GATEWAY Service (“Service”), as a benefit to qualified Canon end users. You can access the Service through your Canon “Canon Account” login.
The Service contains information on Canon products, articles on photography and photographic printing, links to purchase certain compatible supplies and accessories from the Canon Online Store, product and software downloads and online photo album storage. All or some of these benefits may be available to you depending on the Canon products you own and register. Canon reserves the right to make a change, addition or variation of the products and/or services offered through the Service at any time.
The Service is only made available to those end users who own and have registered certain qualifying Canon brand products. Canon may remove, add, replace and otherwise modify the list of eligible products in its sole discretion without notice. End Users who complete the registration form and whose products are qualified for membership to the Service, will have the option to create a Canon Account which will provide access to the Service. The Service is only available to U.S. residents (including residents of Puerto Rico and Guam) who are 13 years or older. IF YOU ARE 13 OR OLDER BUT UNDER THE AGE OF 18, YOU SHOULD REVIEW THESE TERMS AND CONDITIONS WITH YOUR PARENT OR GUARDIAN TO MAKE SURE THAT YOU AND YOUR PARENT OR GUARDIAN UNDERSTAND THESE TERMS AND CONDITIONS.
These Terms and Conditions may be updated by Canon from time to time without prior separate notification to you. You should check the Terms and Conditions each time you access the Service in order to check for any possible update. The subsequent access to the Service and/or use of the individual online services shall constitute acceptance of the updated Terms and Conditions.
The Service and any support are provided to you for personal use at no charge. However, you shall bear any and all costs and expenses that are necessary for you to access the Service or to purchase any product made available from the Service.
Canon will use its commercially reasonable efforts to provide continuous access to the Service, and provide correct and accurate information on the Service. Canon accepts no responsibility for the availability or unavailability of the Service or the accuracy of any of the information available on, sent via, or in connection with the Service. Canon may terminate your use of a Username and/or Password, at any time at its sole discretion without notice. Canon reserves the right at any time to change, modify or discontinue, temporarily or permanently, the Service without notice. Canon reserves the right to not reply to any queries and to not provide any support in connection with the Service.
Canon may subcontract all or any part of its activities relating to the Service, to any third party designated by Canon.
In the event that any digital data, in whatever format, you might have uploaded to the Service ("Material") affects the Services, Canon reserves the right to delete such material without notice, or Canon may request that you modify or delete such Material. In the event that you fail to comply with such request, Canon may delete or modify such Material without notice. Should any of such Material, due to computer viruses or other technically corrupt content, cause interference on the Service or otherwise cause technical difficulties in maintaining the operation of the Service, Canon reserves the right to remove such material from the Service without your consent. In these cases, Canon shall not be liable to you with respect to any loss, costs or damage caused by such deletion or modification.
You undertake not to post to the Service any Materials that are or could reasonably be construed as: (i) false; (ii) defamatory, libelous, obscene, offensive, abusive, liable to incite racial hatred, discriminatory or blasphemous; (iii) in breach of any obligation of confidence or privacy or any trade secret; (iv) infringing the proprietary rights of any third party or for which you have not obtained all necessary licenses and/or approvals; or (v) violating any other law.
You also agree not to transmit to the Service any Materials which could reasonably be held to constitute or encourage conduct that would be considered a criminal offense, give rise to civil liability, or otherwise be contrary to the law of any country or other competent authority, or infringe the rights of any third party enforceable in any part of the world.
Canon reserves the right to remove any Material from the Service, where it reasonably suspects that such Materials are prohibited by this Section 3 or are otherwise inappropriate. Canon, or a third party on behalf of Canon, may disclose information, including without limitation, information concerning a subscriber, a transmission made using any of the Canon services or website, in order to comply with a court order, subpoena, summons, discovery request, warrant, statute, regulation or governmental request. Canon assumes no obligation to inform you that your information has been provided and in some cases may be prohibited by law from giving such notice. Finally, Canon may disclose subscriber information or information transmitted over the Service where necessary to protect others from harm. Notwithstanding the foregoing, you acknowledge that Canon has no control over content on the Service provided by other users, nor does it purport to monitor the content of the Service, to ensure its accuracy, appropriateness or conformity with the principles outlined in these Terms and Conditions.
In the event you breach any of your obligations set forth in the Terms and Conditions, Canon may at its discretion and without notification, cancel your membership to and/or access to the Service, including the deletion of all your albums or other content you have uploaded to the Service.
You can, at all times, unsubscribe from the Service, in accordance with the unsubscribe procedure set forth in the Service. Should you unsubscribe from the Service, all images and videos stored in your account will be deleted.
No cancellation of membership shall, however, affect any obligations you might have accrued under these Terms and Conditions prior to such cancellation.
(Applicable only to eligible Canon camera, camcorder or SELPHY product registrants.)
Canon provides free online storage of still images and video clips (up to 10 GB in the aggregate) to each eligible member of the Service. To maintain storage for images and clips, you must access your library or any album at least once every 365 days or all your images and videos will be deleted. You will receive email notification of impending expiration. We may change this policy at any time, upon reasonable notice to you.
YOU UNDERSTAND AND AGREE THAT THE SUBMISSION OF ANY DIGITAL CONTENT OR IMAGE TO THE SERVICE, AND THE DOWNLOAD OR UPLOAD OF ANY MATERIAL THROUGH THE SERVICE IS DONE AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY LOSS OR DAMAGE TO YOUR CONTENT OR IMAGE OR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT MAY RESULT IN THE DOWNLOAD OR UPLOAD OF ANY MATERIAL. YOU ARE SOLELY RESPONSIBLE FOR CREATING BACK-UPS OF YOUR DIGITAL CONTENT.
Canon does not claim ownership rights in or to any image or video clip uploaded to your library. To enable us to display your images through the Service (for example, in slideshows), you grant to Canon a perpetual, non-exclusive, royalty-free license to use, copy, distribute, and display those images.
Please be aware that when you upload images to the Service, the EXIF data from those images is also uploaded, including any geolocational data if your image was taken with a GPS-enabled camera or memory card, or if you manually added such information yourself as well as any face recognition data. If you do not want to share some or any of this information, you will have the opportunity to review your Share Settings and modify accordingly. This option is further explained in the FAQs.
The Service allows you to share images by sending an email containing a URL link to one of your albums. Please note that when you share images, you may allow the recipients to share the images with others, make photographic prints from those images, upload their own images to your album, and comment on your images; you will, however, have the ability to delete visitor comments made on images and albums in your library. Please note that these options to allow sharing, downloading, commenting and the like are further explained in detail in the FAQs.
If you share an image or video via email through the Service, the email address of the invitee may be stored in the Service for your convenience. If you share images or videos via the Service on the applicable third party sharing sites, your ID and password to such site may also be saved on the Service for convenience.
Canon may make available within the Service, the purchase of Canon products and/or services through a subsite and/or a third party website, (as such third party has been designated by Canon to provide such services to our customers). In that case, you will be redirected to such subsite/third party website and the governing rules of such transaction shall be described in that website. If such products or services are offered through a third party, you agree that Canon shall have no responsibility for the purchase process through such third party website, including but not limited to the shipment, handling and payment.
Any personal information supplied by you via the Service, or by any e-mail correspondence is subject to Canon’s Privacy Statement.
Canon suggests that you check back as new versions of software become available as there may be incompatibilities with the Service that cannot be known at this time.
